General
Tier 1 (General) - Employed or Self-Employed
This category can be considered as the top choice for overseas nationals, with the exception of Indefinite Leave to remain (aka, permanent residency). It gives the holder complete freedom to work for others as an employed person, to work as a self-employed person, or to be the owner of a Limited company.
Unfortunately, the UK Border Agency has made the decision to withdraw the Tier 1 (General) route; therefore, as of 6 April 2011, the the Tier 1 (General) route ceased to exist.
Tier 1 (General) - Extension Applications
As previously, there are four main 'Attributes' for which you are awarded points. Once you reach the magic 75 (see before 6 April 2010 below) core points you will be close to meeting the requirements for your Tier 1 (General) visa extension.
Applications for leave to remain where the applicant has, or last had, leave as a Highly Skilled Migrant, as a Writer, Composer or Artist, Self-employed Lawyer, or as a Tier 1 (General) Migrant under the rules in place before 6 April 2010 and has not been granted leave in any category other than these since 6 April 2010. The first four attributes consist of the following:
- Qualifications (30, 35, or 50 points awarded) - Bachelor, Master Degree or PhD
- Previous Earnings (5 to 45 points awarded)
- UK Experience via study or earnings (5 points awarded)
- Age up to 31 (5 to 20 points awarded)
If you meet the magic 75 points you will then need to meet the Maintenance Attribute.
For applications made from 6 April 2010 onwards. The first four attributes consist of the following: If you meet the magic 80 points you will then need to meet the Maintenance Attribute.
Now onto the perhaps difficult attribute
- Maintenance Funds (10 points awarded)
You must provide proof that you have funds to sustain yourself while you are in the UK seeking employment or starting your own business. There are different amounts required if you are already living in the UK or if you live outside of the UK. The funds required are as follows:
You must prove that you have £800 in the bank or building society in savings for a minimum of three months. prior to making the Tier 1 application. The account should not have dropped below the £800 even by one penny for one day. You will need to provide proof that is less one calendar month old at the time of making the application. These sums of money can be in more than one account but must be under your name or joint names.
If you have a dependent(s) in the UK with you, you will need to prove an additional £533 of funds for each dependent for the same three months. These sums of money can be in more than one account.
